Public Consultation on Amendments to the Law on Public Procurement, March 17, 2014

On Monday, March 17, of the current year , the Public Consultation on Amendments to the Law on Public Procurement was held in Government old building. In accordance with the public call notice addressed to all interested parties, main task of the public consultation was to unify relevant positions and conclusions reached over the Draft of the Law.

Consultation initiated by the Head of the Public Procurement Administration, DSc Mersad Mujevic, in its introductory part focused at the public consultation purpose and the relevance of this topic for all entities at the society.

The Public procurement is one of the ares in which Government make a significant progress  in endeavour to make comprehensive legislative and institutional framework. Reason for all this is that the public procurement represents a sector which is the meeting point of the two significant segments of state economy, with contracting authority on the side of public sector having to ensure that money of tax payers in the procurement procedure shall be spent by observing the principle „best value for money”, and private sector on the other side represented by the bidders.

In its Reports relating to the Montenegro progress in the field of public procurement, the EU recommendation in view of the public procurement system of policy regarding certain parts of the Law is that special attention should be paid to the following areas: competence of the institutions, new directives especially in the utility sector, directive on defence and security, protection of rights, training of the officers, capacity building, better data management, ie statistics. Also, great attention was given to the standards of legal protection and inspection supervision in terms of the manner of submission of appeals, actions and decisions of the contracting authority against which the appeal may be lodged, compensation of the costs paid for the fees for conducting proceedings on appeal, substantial breach of the Law etc.

Besides the Head of the Public Procurement Administration, its introductory speach also gave the Minister of Finance , Phd Radoje Žugić, representative of the EU delegation to Montenegro, Mrs Donka Prodanova, president of the Montenegrin Employers Federation, Mr Predrag Mitrović and the secretary general of the Union of Municipalities of Montenegro, Mr Refik Bojadžić.

Draft Law presentation on Amendments to the Law on public procurement performed by the narrower members of the work group, among which were the assistant director, Mrs Mara Bogavac, member of the State Commission for the control of public procurement procedures, Mr Tomo Miljić,  Head of Department for legal and general affairs in the Chamber of Economy of Montenegro, Mr Aleksandar Mitrović, and the SIGMA expert, Miss Teja Kolar.

Over 150 participants and representatives of NGO sector, Montenegrin bidders and contracting authorities took part in public consultation.

The comments have been sent by the following institutions: Alternativa Institute, Ministry of  Economy, Ministry of Defence, Montenegro Business, Osmi red, Ltd; Central Bank of Montenegro, Customs Administration, Red Cross, Montenegrin Electrical Transmission System, Electric Power Company of Montenegro; they noted that the comments will be sent to the Administration  in writing , of which sublimated version the Work Group will be informed by the Administration incorporating the appropriate proposals thereof to the text of the Law.
