Podgorica, PR Center – The book titled “Selected Judgements of the Court of Justice of the European Union on Public Procurement“ – Montenegrin version, shall assist the officers involved in public procurement procedures to conduct that process in an efficient, cost-effective and operational manner, as it was stated today at the promotion of the said publication.
Director of the Public Procurement Administration, Mersad Mujević, said that the publication on public procurement, prepared by SIGMA in cooperation with that institution, is dealing with important decisions of the Court of Justice of the European Union (CJEU) in nine particular fields.
“This book is a concrete contribution to a better understanding of a new and challenging matter of public procurement, while a special contribution represents a practical application of the concept of public procurement in the business practices of European Union, with references to Montenegrin legal system“, Mujević said in PR Center. According to him, the overall objective of the publication is to raise public awareness about the importance of proper implementation of public procurement procedures.
„To be more precise, the purpose of this manual is to assist the officer involved in the public procurement procedures to conduct those procurement procedures in an efficient, cost-effective and operational manner, taking into account the commercial aspects and acting within our Montenegrin legal framework“, Mujević stated.
The book, as he explained, may be used by the bidders in order to be informed about the national procurement procedures and to be able to participate therein.
„The manual encompasses several important elements – legal framework, procurement policy nad basic introductory aspects, establishment of a procurement strategy, tho role of the officers and all those in charge of public procurement procedures, preparation of tender documents, implementation of a tender procedure, evaluation and appeal procedure and the way the European Court of Justice sees these issuesi“, Mujević explained.
He also stated that the book addresses nine topicsof importance for public procurement, which refer to the Material scope of application, Scope of application – concept of “the body governed by public law“, “Internal“ procurement, Choice of the economic operator – basis for exclusion, Choice of the economic operator – qualification, Contract award, Technical specifications, Amendments to the contract and Remedies.
The result of the publication, as he added, is providing all public procurement officers in Montenegro with a operational instructions which would have the capacity to describe all stages of each public procurement procedure existing at this moment, higlighting the most dangerous errors which should be avoided.
„The analysis that follows through the reading of this book was done in the judgments relating to the time between 2006 and 2014, where most of the relevant cases of the Court of Justice relating to the nine mentioned topics are discussed in terms of start-up, implementation of procedures, and the contents of the judgments and the consequences for disobeying a judgment”, Mujević said.
